Personal liability attaches to us all in various aspects of our home life and workplace, driving our vehicles, owning our homes, carrying out work, participating in leisure activities.

Examples of how we are personally liable include:

Serious traffic prosecutions
Example:Dangerous driving is an offence under the Crimes Act which can attract a fine of up to $20,000 or up to 5 years imprisonment.

Workplace accusations
Example:Offence likely to cause seroius harm under the Health and Safety in Employment Act can face a fine of up to $500,000 and/or a term of up to 2 years imprisonment. There is an obligation for a person who controls a work place to ensure no harm comes to any person in the "vicinity"

Criminal prosecutions
Example:Assault under the Crimes Act allows for an indivudual to be liable for a term of up to 3 years imprisonment.

Neighborhood disputes
Example:Boundary issues

Local council disputes
Example:Noise issues under the Resource Management Act, or issues that arise under the Local Council District Plan such as building permits.

    Private agreement or contract disputes
    Example: Sale of a property. Under a standard Sale and Purchase agreement there are Vendor warranties which include
      • No notice received by any authority with regard to requistion
      • No outstanding requirements under the Resource Management Act
      • Work undertaken on the property complies with permits and/or consents
    Watercraft Activities
    Offences under any Marine Statute, example Maritime Transport Act 1994 or Regional Council by laws. Note that Fisheries Legislation is specifically EXCLUDED under the policy.
